Terms of Service. The agreement between you and Phone.inc, written so you can actually read it.

These terms cover every Phone.inc service: our website, our apps, your phone numbers, and the calls you make and receive through them. They apply to both the free plan and paid plans.

You must accept these terms before activating any calling service. By creating an account or using Phone.inc, you agree to them and acknowledge our Privacy Policy. If something is unclear, email us at [email protected] and we'll explain it in plain words.

§01 — Who we are

You're making an agreement with Phone Incorporated ApS.

Phone.inc is operated by Phone Incorporated ApS, a Danish company registered under CVR DK-46213564, at Højbro Plads 10, 1200 Copenhagen K, Denmark. When we say "we", "us", or "Phone.inc", that's who we mean.

Phone.inc is a service for business customers only. By signing up, you confirm that you're using it for business purposes, that you're at least 18 years old, and that you're authorized to accept these terms on behalf of your company.

Phone.inc routes voice traffic to the United States and maintains a robocall mitigation program certified in the FCC's Robocall Mitigation Database, as required under 47 CFR § 64.6305. U.S.-bound traffic is routed through upstream providers that participate in industry traceback efforts.

§02 — Your account

Keep your account accurate and secure.

Give us accurate information when you sign up, and keep it up to date — including a valid business address. Keep your login credentials safe. You're responsible for everything that happens under your account — including how every employee or other person you give access to uses Phone.inc. If you suspect someone else has access, tell us right away.

To make outbound calls, you must be a paying customer with a valid credit card on file and a valid business address. We use our payment provider and other tools to detect payment and account fraud.

We may require you to complete a full Know Your Customer (KYC) check and provide proof of address at any time, at our discretion. If we ask, you must provide what we need to keep your account open. If you don't, we may suspend or close your account.

§03 — Plans and billing

Monthly billing. Cancel anytime. No tricks.

Phone.inc is a monthly subscription. We offer a free plan and paid plans. Paid plans are billed monthly, in advance, on the same day each month.

Free plan. Each company may have only one active free account at a time. You may not create multiple companies or accounts to work around this limit. The free plan may include fewer features, numbers, or usage limits than paid plans — and we may change what the free plan includes at any time. Outbound calls require a paid plan (see §02). Numbers on the free plan are not eligible for port-out (see §07).

You may downgrade from a paid plan to the free plan only if your company does not already have another active free account and your current usage complies with the free plan — including the number of employees and main numbers on your account. If you have more employees or main numbers than the free plan allows, you must reduce your usage before downgrading. When you downgrade, you lose access to paid-only features — including outbound calling. Your port-out eligibility starts over: you must be a paid subscriber for at least one full month again before you can port your number out under §07.

We may stop offering a free plan altogether. If we discontinue the free plan for accounts that are already active, we'll give you at least one month's written notice before your free service ends. You may upgrade to a paid plan during that notice period to keep your phone number and service. If you don't upgrade before the free plan ends, your number may be released and your account may be closed.

  • Cancel anytime. Your service keeps running until the end of the billing period you've paid for. We don't refund partial months when you cancel, but we never charge you again after you do.
  • Price changes get notice. If we change the price of your plan, we'll email you at least 30 days before the new price takes effect. If you don't like the change, cancel before then and the old price applies until you leave.
  • Failed payments. If a charge fails, we'll retry and let you know. If payment keeps failing, we may suspend or downgrade your account after giving you a reasonable chance to fix it.

§04 — Acceptable use

Manual calls and messages only. No robocalls. No spoofing.

Phone.inc is designed for manual, person-to-person business calls. For outbound calls, there is no way to place a call through Phone.inc without a human in the loop — every outbound call must be manually initiated by an authenticated user in our mobile or desktop app. We offer no SIP access, no dialer API, and no other mechanism to initiate, automate, script, or bulk-place outbound calls. Our API lets you manage your account, configure routing, and receive webhooks — but it cannot start an outbound call for you. You may only use phone numbers (DIDs) purchased through Phone.inc, and your caller ID is always set to your assigned DID on outbound calls — you cannot alter, spoof, or circumvent it.

Phone.inc connects real calls to real phone networks, so the laws of every country you call into apply to you. In the United States, that includes the Telephone Consumer Protection Act (TCPA), the Truth in Caller ID Act, the TRACED Act, and FCC rules at 47 CFR § 64.1200 and § 64.6305. In the United Kingdom, that includes the Privacy and Electronic Communications Regulations and Ofcom rules. In the European Union, that includes the ePrivacy Directive and its national implementations.

Using Phone.inc, you agree that you will not:

  • Use the platform to originate automated, prerecorded, or artificial-voice calls — including AI-generated voice calls — or send automated messages, without the prior express consent of the called party as required under the TCPA and applicable law.
  • Originate robocalls, spam calls, or any other calling activity that violates U.S. federal or state law, including the TCPA, the Truth in Caller ID Act, or FCC regulations at 47 CFR § 64.1200 and § 64.6305.
  • Manipulate, falsify, or circumvent caller ID presentation in any way. Your assigned DID is the only caller ID presented on outbound calls.
  • Use the platform in any manner inconsistent with manual, person-to-person calling — including attempting to automate, script, or bulk-initiate outbound calls through any means.
  • Send automated, bulk, or spam text messages without the prior express consent required under the TCPA and applicable law.
  • Use text messaging in any manner inconsistent with manual, person-to-person communication — including attempting to automate, script, or bulk-send messages through any means.
  • Call numbers on do-not-call registers — such as the U.S. National Do Not Call Registry or the UK Telephone Preference Service — unless you have the consent or existing relationship the law requires.
  • Ignore opt-outs. When someone asks you to stop calling or texting, stop.
  • Use the service for harassment, threats, fraud, traffic pumping, one-ring scams, artificially inflated traffic, or anything else illegal.

Where call recording or transcription is enabled on your account, you are responsible for informing call participants that the call is being recorded or transcribed, where the law requires you to do so.

Complying with the laws that apply to your calling and messaging is your responsibility. Breaking those laws through Phone.inc is also a breach of these terms, and we treat it as one.

§05 — Monitoring and traceback cooperation

We watch for abuse and cooperate with enforcement.

All use of Phone.inc is subject to continuous monitoring — inbound and outbound calls, text messages, and other product activity included. We review call volumes, calling patterns, call durations, destinations, signaling data, messaging activity, and account information to detect fraud, robocalling, spam, or other misuse. We flag unusual activity — including abnormally high call volumes, anomalous call durations, or traffic patterns inconsistent with manual calling — for compliance review. We also act on complaints received from called parties or downstream carriers.

All outbound calls present your assigned DID as caller ID. We validate caller ID values against E.164 formatting requirements. If we identify suspicious activity, we may contact you to explain the traffic, suspend your account pending review, or terminate your account.

Phone.inc cooperates fully with traceback requests from the FCC, the Industry Traceback Group (ITG), and other authorized enforcement entities. Upon receipt of a traceback request, we commit to responding within 24 hours as required under 47 CFR § 64.1200(n)(2), identifying the source of the call within our network, notifying the relevant account holder where appropriate, and taking immediate corrective action — including account suspension or termination — where a violation is confirmed.

Where the law requires or permits it, we may share relevant information with carriers, traceback groups, regulators, or law enforcement. If we have reason to believe you have used Phone.inc for fraud, criminal activity, or any other illegal purpose, we will report it to the police and turn over whatever evidence we have. We cooperate fully with law enforcement — in Denmark and in every other country where the activity took place or caused harm.

We retain call records, messaging activity, account information, and compliance investigation logs for as long as needed to meet our regulatory obligations, respond to traceback requests, investigate abuse, and defend against fraud. That may be longer than the retention periods described in our privacy policy.

If you believe someone else is using Phone.inc for fraud or illegal activity, you're welcome to report it to [email protected]. We take every report seriously and will investigate. Other compliance inquiries go to the same address. How we handle personal data is described in our Privacy Policy.

§06 — Suspension and termination

Either of us can end this. Here's how that works.

You can close your account at any time, for any reason.

We may suspend or terminate your account at any time, for any reason, at our sole discretion and without liability. When we do, we may shut down all services on your account, including the ability to make calls, receive calls, and use your phone numbers.

  • With cause. If you breach these terms, engage in non-compliant, suspicious, or unlawful activity, or your account creates legal, fraud, or network risk, we may suspend or terminate immediately and without prior notice or refund, at our sole discretion. We'll tell you the reason unless the law prevents us from doing so.
  • Without cause. If we end your service and you've done nothing wrong, we'll give you at least 30 days' written notice, refund any prepaid fees for the unused period, and help you export your data and port your number out.

§07 — Porting your number

Your number is your business. You can take it with you.

After you've been a paid subscriber for at least one full month, you have the right to port your phone number to another provider. We'll cooperate with your new provider promptly and won't charge you a port-out fee.

Numbers used only on the free plan, or on accounts that have been paid for less than one month, aren't eligible for porting under these terms. If your account is closed in the ordinary course, we'll keep your eligible number available for porting for 30 days where we can.

This port-out right does not apply if we suspend or close your account for fraud, unlawful activity, or any breach of these terms. In those cases, we may withhold your number during an investigation and are not obligated to release it for porting. We may also share relevant information with carriers, regulators, or law enforcement as described in §05.

Nothing in this section limits any stronger porting rights you have under the law where you are.

§08 — Emergency calls

Phone.inc is not for emergencies.

Phone.inc is an app-based calling service. Calls to emergency numbers like 911, 112, or 999 may not work, may not connect to the right dispatch center, and may not transmit your location. Always keep another way to reach emergency services, such as a mobile phone with a regular cellular plan.

§09 — Your data

Your data belongs to you.

Your call history, voicemails, contacts, and settings are yours. You can export your data while your account is active, and we'll help you do it if we terminate without cause. You can also ask us to delete your data at any time — see our Privacy Policy for how that works.

We do not use your call recordings, transcriptions, voicemails, or other communications content to train AI models. AI features process your content only to deliver the service to you.

After your account closes, we delete your data on the schedule described in our Privacy Policy, except where the law requires us to keep it longer — including compliance and call records retained under §05.

§10 — What we promise, and what we don't

We work hard on reliability, but we can't promise perfection.

We do our best to keep Phone.inc fast and available, but the service is provided "as is". Phone networks, carriers, and the internet are involved, and sometimes things outside our control break.

To the extent the law allows, our total liability to you is limited to the fees you paid us in the 12 months before the event giving rise to the claim, and we're not liable for indirect losses like lost profits or lost business. Nothing in these terms excludes liability that can't be excluded under applicable law.

If your use of Phone.inc causes us to face claims, fines, penalties, or costs — from regulators, carriers, traceback groups, or anyone else — because you broke these terms or applicable law, you agree to cover our reasonable costs and damages to the extent the law allows.

§11 — Changes to these terms

These terms can change. Here's how.

We may update these terms at any time by posting the revised version at phone.inc/terms. The date at the top shows when they last changed. If you keep using Phone.inc after a change takes effect, you accept the updated terms.

The only changes we treat as material are increases to the recurring subscription fee on your current paid plan. For those, we'll email you at least 30 days before the new price takes effect. If you don't agree, cancel before then.

We may make any other change — including to acceptable use, monitoring, termination, porting, liability, or compliance — without advance notice, when required by law or regulators, or when we reasonably believe it's needed to protect Phone.inc, our network, or other users.

§12 — Governing law and contact

Danish law, and a real inbox.

These terms are governed by Danish law, and disputes are handled by the courts of Denmark. If the law of your country gives you mandatory rights that can't be waived by contract, those rights still apply to you.
